Re: Accelerated Examination Program (AEP) in Taiwan — positive results being reported 

Dear Sirs, 

As you may already know, the Taiwan Intellectual Property Office (the IPO) has launched a program for accelerated examination as of January 1, 2009 for a one-year trial period.  Under this program, an accelerated examination may be requested by an applicant whose invention patent application is still under examination and the corresponding application(s) has been substantively examined and allowed by any foreign patent authority.  In general, after said request is filed, the applicant may expect to receive the IPO’s examination result within 6 months. 

Now, we are pleased to advise you that according to our survey, we noticed that from January to May, in AEP program, the average time to receive the IPO’s examination result is just 38 days after filing said request.  It is obviously that by utilizing this new program, the examination procedure can be accelerated effectively.  We, therefore, encourage the clients, whose cases are in conformity with the above-mentioned provisions of accelerated examination and intend to receive an examination result earlier, to utilize the advantage of this program and file a request for accelerated examination ASAP.

When a request for accelerated examination is necessary, please provide us with the following documents:

1. Claims allowed and published by the foreign patent office; or a notice of allowance rendered by the foreign patent office together with the claims that are going to be published;

2. A statement indicating the differences between the claims of the corresponding foreign application and the Taiwanese application (Please provide us with the description of the differences.  If no differences exist, this document can be omitted);

3. Other beneficial documents, such as the search report, the marked-up specification indicating the differences between the specification granted by the foreign patent office and the specification submitted to the IPO for the Taiwanese application, the office action rendered by the foreign patent office and the response can be submitted simultaneously to assist the patent examiner to accelerate examination. (If no such documents available, those documents can be omitted)
