Compensation of NT$15,690,000 to be Paid to Microsoft for Profit of NT$50,000 Gained by Sale of Pirated Game Software.

A 24-year-old man who was hired to sell pirated XBOX software of Microsoft and gained profits of NT$50,000 was ruled to pay NT$15,690,000 to Microsoft as compensation and run an apology notice in the newspapers.  This man was financially incapable of paying such an amount, and he was also sentenced to 8 months in prison and put on a probation for 3 years for his criminal offense.  Such judgment has become final.

    Taipei District Court found that there were 513 kinds of pirated software uncovered against this man.  The compensation amount payable to Microsoft is calculated at the rate of NT$30,000 each kind of software plus NT$300,000 as compensation for trademark infringement, totaling NT$15,690,000. 

  Microsoft Taiwan expressed that the penalty imposed in civil action judgments on IP infringement matters committed by individuals in Taiwan are extremely difficult to be effected.  (2006.02)
