A Fine Punishment Shall Be Imposed On Misuse of Legal Procedure.

An administrative action is initiated usually when businesses disagree with the administrative act effected by administrative agencies for issues on tax levy and patent or trademark registration application, etc.  It is also common that an appeal is filed for dissatisfaction with the judgment rendered by the administrative court or even an administrative action for retrial is initiated against an irrevocable judgment, and this situation has caused serious waste of judicial resource.

For this situation, the Judicial Yuan amended the Code of Administrative Proceedings by adding that if an action is initiated without a valid reason, the court shall dismiss such action by a ruling and fine the person concerned up to NT$60,000.  Likewise, in the case of an action initiated abusively for retrial, a fine up to NT$100,000 shall be imposed to the person concerned.
