First Utility Model Patent Technical Report Presented.

After the implementation of the amended Patent Law, the first utility model patent technical report (Utility Model Patent No. 92206885) in our country has finally been presented.  Rights may be claimed to the third person once the patentee receives a technical report.  In the amended Patent Law implemented on July 1, 2004, the application of utility model patent has adopted “form inspection.”  The Intellectual Property Office can approve a utility model patent application so long the relevant requirements are met.

IPO indicated, using form inspection for utility model patent applications is beneficial to products of short life cycle so that they may receive the protection of patent rights as soon as possible.  However, if a patentee of utility model patent rights wants claim his or her utility model patent rights, he or she shall present a utility model patent technical report in accordance with the law.  (2005.4)
