Restrictions on Technique of Research and Development for Entering China may Loosen.

Restrictions on research results of the Ministry of Economic Affairs’ project for entering China will loosen. The Ministry of Economic Affair will refer to regulations, such as “operation items that are prohibited form engaging in investment and technique cooperation in China,” to broaden restrictions on results of technology project of non-prohibited items; the results may be used in China after summary examination or report for later approval.

According to statistic made by the Ministry of Economic Affairs, during the recent three years, government has subsidized NT$14,000,000,000 ~ NT$20,000,000,000 each year to promote cooperation between association of legal person, such as Industrial Technology Research Institute, and private sector and academic community to proceed with research and development of technology project. The average number of patents obtained around the world each year is about 800 pieces, and money companies invested exceeds NT$20,000,000,000, including TSMC, UMC, Chimei, and acer had accepted the subsidy of technology project.

However, Department of Industrial Technology, the Ministry of Economic Affairs and Investment Commission have different restrictions on manufacture of results of technology project in overseas areas. According to “Key points for manufacture or use of research results of the Ministry of Economic Affairs’ technology project outside the jurisdiction of our country,” if research results of technology project be manufactured and used outside the jurisdiction of our country, they not only shall be sent to the Ministry of Economic Affairs for approval but also shall not hamper our national security and public interest. Besides, the manufacture and use of these results shall not cause bad influence on our relevant industries and economic development and violate laws of our country or relevant regulations, such as international agreement. If results of technology project manufacture or use in China, they shall conform to “Statute of Relation between People from the Taiwan Area and People from the Mainland China area” and shall be examined by the Ministry of Economic Affairs regarding whether the technique decrease core competition of domestic companies.
