Adidas Lost The Case Against JUMP For Trademark Similarity.

Taiwan’s “JUMP” stands against the world-famous sports brand, Adidas!  Because both JUMP and adidas trademarks are composed of three stripes, the Intellectual Property Office (IPO) rules they are similar to each other and would invalidate the registration of adidas trademark.  Adidas is dissatisfied with IPO’s decision and thus initiates an administrative proceeding; however, the High Administrative Court also holds that the two trademarks are easily to mislead the consumers and renders a judgment against adidas.

 

Compared carefully, adidas and JUMP trademarks are both styled with 3 stripes sloping and shortening from right to left, which constitutes similarity in external appearance of the two marks.  In addition, since both trademarks are representative ones used on sports shoes, the IPO determines that the two trademarks are similar and then decides to invalidate adidas’ trademark registration upon the application for invalidation filed by JUMP.
