Trademark Right Is Auctioned to Offset Several Hundred Millions of Unpaid Taxes.

The trademark right owned by one well-known chain restaurant, “ACHOICE Seafood Restaurant Group” (阿秋活蟹) in Taichung area was publicly auctioned by the Taichung Branch of Administrative Enforcement Agency, Ministry of Justice on May 24. This trademark was knocked down at the price of NT$318 thousand dollars and the trademark right should be transferred to the buyer accordingly.

 

Ministry of Finance indicated that this auction was a successive example, in which the intangible assets were auctioned to offset unpaid taxes. The taxpayer’s property inventory made by the tax collection authorities will not contain tangible assets only in the future; instead, some valuable intangible assets, including patent right, trademark right, and copyright, etc., will be included into property inventory for the collection of unpaid taxes and are likely to be auctioned to offset outstanding taxes.

 

After the Branches of Administration Enforcement Agency have been established, tax collection authorities share intimate cooperative ties with the Branches of Administration Enforcement Agency thereafter. In such cooperative relationship, the tax collection authorities are responsible for preliminary procedures, such as sending out tax bills and notice for tax recovery, etc.. If the payer of tax arrears does not make a payment, the tax collection authorities will pass the information regarding such payer, including property inventory, to the Branches of Administration Enforcement Agency for the latter to attach and auction such payer’s properties, or arrest and place him under custody according to the information passed by the tax collection authorities.
