A Maximum Fine of NT$25,000,000 Shall Be Imposed on Circulating Trader’s Joint Pricing.

Fair Trade Commission indicates that circulating trade in Taiwan tends to large-scale operation as a result of foreign participation in Taiwanese market. Though such a tendency favors industrial development, it leads to confined competition in transactions because trading counterparts in circulating trade, such as suppliers or suppliers of counter, are mostly small & medium enterprises whose market status or market force is extremely inferior to that of circulating trade.

 

With a tendency toward large-scale operation and internationalization of circulating trade, Fair Trade Commission plans to enact provisions regulating competition in circulating trade to prevent circulating traders from abusing market advantage and thus eroding fair competition. Under such provisions, circulating traders’ private joint pricing in the future will violate the Trademark Law and shall be fined up to NT$25,000,000.
