Downloading of Unlicensed Mobile Phone Anime Will Violate the Copyright Law.

Having investigated several cases of copyright law violation, the prosecutor of Taipei District Prosecutor’s Office finds that telecom value added service providers offer telecom companies the unlicensed internet anime or comics without copyright holder’s consent for telecom companies’ reselling such anime or comics to mobile phone users further for the users’ downloading. Such unauthorized resale of internet anime and fee collection violate the Copyright Law.

 

It is known that authors or exclusive licensee of the comics and internet anime circulating in the market possess the economic rights of these works and are protected by the Copyright Law. In this way, reproduction and resale without economic right holder’s consent or authorization will violate Article 91 and Article 101 of the Copyright Law and Article 56 of the Criminal Code.
