Trademark Holders May Apply for Seizure upon Trademark Infringing Imports and Exports.

In response to the demand of other foreign countries regarding intellectual property rights protection, the Ministry of Finance announced yesterday “Operational Procedures of the Customs Seizing Trademark Infringing Goods,” stipulating that trademark holders may apply for seizure of trademark infringing imports or exports. However, trademark holders must provide a security deposit equivalent to the duty paid price of the imports or the FOB (Free On Board) of the exports. The party whose goods are detained may provide a double amount of security deposit to request an annulment of the seizure.
