System of Expert’s Participation in Trial Will Be Introduced into Court’s Trial.

As a concerned party of an engineering dispute case, do you agree that an engineering expert sits beside the judge and keeps contributing his ideas in the trial process? In accordance with the “Statute for Expert’s Participation in Trial” drafted by the Judicial Yuan, the scope of expert’s trial includes civil, criminal, and administrative actions; the judge in charge of the high court and district court can choose two experts to act as “judges in trial” according to the concerned party’s petition to form a collegiate panel.

System of expert’s participation in trial will be adopted in such cases including construction engineering, copyright and patent rights, marine pollution, and security exchange cases, etc. in civil field, medical disputes that cause death or severe injury, sexual assault, and juvenile protection cases, etc. in criminal cases, and copyright, trademark right, and patent right related cases and marine, soil, and noise pollution cases, etc. in administration actions.
