Control Yuan Appreciates Fair Trade Commission’s Efforts in Investigation on Microsoft Case With Only One Flaw in Investigation Quality.

The Control Yuan on October 6, 2004 released its special report on the case of “Microsoft” exploiting its monopolistic position in the market to tie the sale of other software to that of its monopoly product and adopting global pricing mode, and thus violating the Fair Trade Law in Taiwan.

 

The said Yuan indicated that the administrative settlement agreement between the Fair Trade Commission and Taiwan Microsoft is concluded for the settlement reached between Taiwan Microsoft and relevant enterprises on the issues of pricing and tying sale of “Traditional Chinese Windows and Office (Retail Box) and specific Office program”, while the said Commission should still investigate and impose punishment on the pricing and tying sale of other Microsoft products if in violation of the Fair Trade Law.

 

The said Yuan appreciates the Fair Trade Commission for its “combating” the biggest software company and expediting Taiwan Microsoft’s request for administrative settlement in the long run within one year. The said Yuan, however, holds that there is still a lot of room for the said Commission’s improvement, such as the failure in performing investigation responsibility, etc.. (2004.10)
