District courts will set up administrative proceeding courts

The Code of Administrative Proceedings of this country currently adopts two trials at two court levels. However, in response to the daily increasing appeal cases against administrative penalties, the Judicial Yuan’s medium-term reform project has been made. It is expected in the future that the system will be three trials at three court levels or two trials at three court levels. Administrative proceeding courts will be set up in various district courts to specifically examine disputes and cases about public law such as travel, election, impeachment or national compensation, etc.

 

  On the other hand, for counties and cities where the numbers of cases are many and the nature of such cases is complicated, district administrative courts will be set up further if setting up administrative proceeding courts still cannot satisfy the need. 

 

  Presently, there are three high administrative courts set up respectively in Taipei, Taichung and Kaohsiung and there is one Supreme Administrative High Court. However, there is no district administrative court or administrative proceeding court. After administrative proceeding courts are set up in district courts or district administrative courts are set up, their trial systems will be similar to those of the criminal and civil proceedings.
