Application for employment of foreign talent in Taiwan scheduled to be handled by Council of Labor Affairs solely

  In order to simplify the procedures for the applications of foreign talent (namely, white-collar foreign labors) for working in Taiwan and to help enterprises recruit talent, the Council of Labor Affairs drafted the “Guidelines to Approve Employment of Foreigners”.  In the future, the foreign workers’ applications for approval on their employment in Taiwan, no matter they are white-collar workers, blue-collar labors, foreign students, or overseas Chinese students, will be handled by the Council of Labor Affairs solely, provided that the applications of the specialists in certain lines of business for which special licenses are required, such as doctors, attorneys, private pilots and so on, will be examined by competent authorities in charge of the business as authorized by the Council of Labor Affairs.

 

   Towards some specialized or technological work, in order to prevent employers from introducing blue-collar foreign labors in the name of white-collar foreign labors so as to jeopardize local nationals’ job opportunities, the Council of Labor Affairs increased certain limitations on salaries, defining that the wages payable to the white-collar foreign labors to be introduced by employers shall not be less than the average wages paid to the staff of local industrial and service businesses for the latest one year.

 

   Towards the employers scheduled to employ the white-collar foreign labors, the Council of Labor Affairs also set some limitations on their qualifications, including that the paid-in capital of the company that has been established for less than one year should be over NT$5,000,000, and the average sales value of the company that has been established for more than one year should be more than NT$10,000,000 for the latest one year or within three years.  Meanwhile, certain extra limitations were also set on the qualifications of corporate bodies and juridical associations.
