Passed Amendments to Basic Law of Science and Technology protecting trustee research institution from being bounded by Government Procurement Law

   The Amendments to Basic Law of Science and Technology passed the Legislative Yuan after final reading.  In order to strengthen the policy for upgrading innovation of technological research and development and to encourage research institutions, the Amendments provide that where corporations or associations accept the subsidization offered by government, they shall not be subject to the Government Procurement Law.  Meanwhile, in order to recruit technological talents from outside of the territory, the Amendments also provide protections for their children’s schooling rights.

 

   The Basic Law of Science and Technology is referred to as the government’s basic criteria and principle to promote scientific and technological development.  In order to prevent research institutions, enterprises or other third parties from failing to work effectively or working improperly the intellectual property and achievements acquired by them so as to interfere with the purpose of enacting laws to make public the technological research achievements, the Amendments provide that under some specific circumstances, the agency that offers the subsidization shall be entitled to license a third party to work them, or to expropriate them as state property.
