Supreme Court: video recording at ATMs admissible evidence

E030521Y9 Jun. 2003(E45)

Can the image captured by video recording equipment installed at automated teller machines be viewed as valid evidence?  The judges of Supreme Court’s criminal division, after holding a meeting on May 20 to discuss this issue, came to the conclusion that video recording of this kind can be admitted into evidence because it is entirely based on mechanical working and is exempt from subjective elements.

Since the latest amendment to the Code of Criminal Procedure, strict evidentiary rules are applied in the trial procedure.  Any material that is not obtained through conscientious, careful and legal methods, such as unauthorized wiretapped or videotaped recording, will be viewed as inadmissible evidence.
