US-ROC Reciprocal Agreement on Police and Judicial Cooperation in Criminal Matters to be executive and effective this 27

The US-ROC Reciprocal Agreement on Police and Judicial Cooperation in Criminal Matters will be executed in Washington this 27 and effective on the same day. 

 

The said Agreement is completely based on an equality and reciprocity.  Scope of assistance, contents of request, method and execution, transfer of detainees, validity of evidence, search and seizure, confiscation procedure, etc. are explicitly provided in the Agreement.

 

On the other hand, the Ministry of Justice has also finished a preliminary amendment to the Money Laundering Control Act for the practical cooperation in criminal matters with the US Department of Justice.  Important contents of the amendment are adding provisions concerning asset freeze and confiscation, confiscated properties sharing system, and declaration system for large transactions.  The reason provisions relating to asset freeze are added to the Money Laundering Control Act is because Article 2 of the US-ROC Reciprocal Agreement on Police and Judicial Cooperation in Criminal Matters has included freeze and confiscation of the assets of organized criminal groups in the scope of reciprocal assistance.  This provision also represents the US-ROC cooperation in anti-terrorism, another major significance.
