Special Reference to Computer Crime Released – Theft of Internet Banking Property Could be Sentenced to Imprisonment of Five Years

The yearlong researching task of the Ministry of Justice on the special reference to regulations on computer crime was concluded lately.  In order to curb the high-tech crime, the Draft of the regulations defines that the imprisonment of not more than 3 years which was supposed to be imposed on the crime of stealing banking property through the Internet should be changed to the imprisonment of not more than 5 years.  Further, the Draft also adds some provisions defining related punishment for the imprisonment ranging from 3 years to 5 years against the acts such as intruding and interrupting others’ computer and producing computer virus and writing criminal programs.  As to the grave crime such as producing and distributing computer virus, it could be sentenced to the imprisonment of not more than 7 years pursuant to the Draft, and even attempted criminals will be punished as well.
