Court Fee Payable in Civil Action Will Increase 10% as of August

As of August 1, 2002, court fees payable in civil actions will increase 10%.  According to the Judicial Yuan, the increase in court fees, which can prevent judicial resources from wasting, produces minor effects on the public on the one hand and enable the revenue of the national treasury to increase about NT$20,0000,000 per year on the other hand.  The increase could serve as the source of the legal allowance to be enforced in the near future.

 

The High Court indicated that in addition to the assessment costs that should be verified and payable by the concerned parties, for the time being the conciliation commissions in the district of township and cities should not impose any costs for reconciliation of civil disputes, and also not any costs would be imposed for the reconciliation procedure provided for in the Code of Civil Procedure.  The High Court considered that the increase in court fees payable in civil actions should be helpful for the concerned parties to apply the reconciliation system and enable judicial resources to be applied more effectively.

 

Currently, the court fees payable by the one who brings a civil action over rights on property are 1% of the value of object of the action.  According to the new standard for imposition of cost, the court fees will increase 1.1% as of August 1, and if an appeal is filed, the court fees thereof will be increase to 1.65% from 1.5% of the value of object of the action, while not any costs will be imposed if the case is remanded for re-investigation.  As to the civil actions other than those over rights on property, such as the claim for rehabilitation of one’s reputation, the court fees will increase one-seconds.
