Half taxed royalties to approved patent

E020801Y1 Sep. 2002(E37)

The Taipei High Administrative Court recently ruled that an individual selling an invention patent should be taxed for the income derived therefrom, as such income is deemed earned by transaction of property.  However, if the patent is approved and registered with the competent authority, the patent right holder may be half exempted from income taxes on royalties or income derived from the sale of such patent right, according to the Statute for Upgrading Industries.
