Supervision over communication applicable to investigation on cybercrime

The Ministry of Justice revised the “Law of Protection and Supervision Over Communication” and planned to increase crucial articles to this Law. On the premises of fighting with all strength against new technical crimes, all crimes committed “mainly by means of communication” are contemplated to fall within the scope of supervision over communication. Under this Law, crimes of various types committed via the Internet in the future can be investigated by supervision over communication and such supervision will no longer be limited by the strict requirements prescribed by the present law.

 

Under the present law regarding supervision over communication, a letter for supervision over communication will not be issued unless a crime is subject to a principal punishment of not less than three years, or a certain crime. However, in terms of the various acts committed by using Internet as the major criminal tool, such as web hacker and web stealth of data, etc., they rarely meet the aforementioned requirement even under the new contemplated draft of the specific “Chapter Against Computer Crime.”
