Taiwan Bureau of Foreign Trade No Longer Receives Applications for TEMS Recordation of Registered Trademarks.

On July 8, 2010, the Taiwan Ministry of Economic Affairs deleted Article 13 and 14 of the Regulations Governing Export of Commodities with respect to the stipulations of TEMS (Trademark Export Monitoring System) recordation application and the customs checking procedure.  From that day, Bureau of Foreign Trade has stopped receiving new TEMS recordation applications.

For providing sufficient protection over the rights of the trademark owners whose registered trademarks have been recorded in the TEMS before BOFT officially stops receiving recordation applications and still remain in the valid term of trademark right (subject to the expiration date of the current term of trademark right as recorded in the system), the trademark owner or its agent is still eligible to request for modification of recordation data if necessary (including the data the trademark owner and its Taiwanese agent, trademark device, descriptive indicators of particular characteristics of trademark, specified categories of product items for trademark use, data of the user permitted for trademark use, description of goods permitted to use the trademark, country of destination, and effective period of the permission granted, etc.) with the Bureau according to current applicable regulations, except for the request for trademark term extension.  The customs will continue practicing the checking procedure until the trademark term expires.  (2010.07)
