Applied Materials Lost Its 5-Year Patent Suit against Jusung in Taiwan.

The Xinzhu District Court, Taiwan finds in favor of defendant Jusung in the patent infringement action brought by Applied Materials five years ago. (Xinzhu District Court Civil Judgment under case No. 93-Zhong-Zhi-3 [2004])

The dispute between these two world’s major display equipment suppliers began with Jusung’s sale of equipment to CMO.  Applied Materials filed for preliminary injunction to stop the sale alleging the Jusung equipment was an obvious infringement of its patent.  Applied Materials brought the patent lawsuit against Jusung soon thereafter claiming TWD178.2 million in damages.

The Xinzhu District Court handed down the judgment holding that Applied Materials has overly construed the scope of its patent in issue in contravention of the Patent Act and therefore dismissed all of the claims raised by Applied Materials.  Applied Materials can take an appeal to the Intellectual Property Court within the given time limit.  (2011.01)
