Guidelines on Taiwan-Japan Cooperation on Deposit of Biological Materials in Relation to Patent Procedure Come into Force in June

According to Taiwan IPO, for filing a patent application for invention involving a biological material or utilization of a biological material, the applicant shall make a deposit of the biological material.  Taiwan and Japan signed a memorandum for a cooperative program on mutual recognition of deposit of biological materials for the purpose of patent procedure on November 20, 2014, the purpose of which is to lessen patent applicants’ burden of repeatedly making duplicate deposits in respective country. 

To implement the above-mentioned framework for Taiwan-Japan biological material deposit cooperation and to ensure the smooth processing of such a framework, Taiwan IPO released a draft “Guidelines for Taiwan-Japan Cooperation on Deposit of Biological Materials in Relation to Patent Procedure”, which was announced by the Ministry of Economic Affairs on June 1, 2015 [Jing-Shou-Zhi-Zi No. 10420030371] and has come into force since June 18, 2015.  (May 2015)
